ezDivorce can help you obtain a cheap and quick Ontario, Canada 'simple' sole/uncontested divorce or joint divorce from only $350. Get a professionally drafted separation agreement for $300.

ezDivorce only assists with 'simple' divorces: one in which you are asking the court to grant you a divorce only - you are not asking for the court to grant orders with respect to anything else, including, but not limited to: spousal support, child custody, access and support, etc. 

ezDivorce prepares and files all of the necessary forms required to obtain your Ontario 'simple' divorce. You will fill out a simple intake form - we then prepare and file the paperwork with the court. The entire process averages 2 to 3 months (from when your application is filed with the court until the divorce order is granted). However, some court locations can be much slower. Requirements (summary):

  1. Residency - Either you or your spouse must be living in Ontario for at least one consecutive year at the time the divorce is filed.

  2. Divorce Only - We only deal with 'simple' divorces - your only request can be for a divorce - no orders for spousal support, child custody/access/support, division of property, etc.

  3. Legal Basis for Divorce - Your divorce must be based on separation or adultery. Read this for more information about separation or adultery as the legal basis for divorce in Canada.

  4. Documentation

    Separation Agreement? - Although any lawyer would recommend that you have one, the court does not require that you have a separation agreement to grant a divorce. It is highly recommended that you have one, especially if you have marital property that must be divided and/or minor children. Read more here.

    Marriage Certificate -If you do not have your marriage certificate, you must* obtain a replacement. If you were married in Ontario, click here for information on how to obtain a replacement. *If you were married outside of Canada or the USA, you must use your best efforts to obtain a replacement certificate - however if this proves to be impossible, the court will still grant your divorce.  If your marriage certificate is in a language other than English or French, you must obtain a certified translation into either English or French.

    Prior Divorce/Death - If your current marriage took place outside of Ontario*, you must provide proof of your prior divorce - but if it proves to be impossible to get a copy of your foreign divorce certificate, you will still get your Ontario divorce. (*Although the Divorce Act states 'Canada', most courts in Ontario require this proof if your current marriage took place outside of Ontario.)
     

  5. "Serving" your Spouse with a copy of the divorce papers

    Unless special permission is obtained by the court in advance, your spouse must be given a copy of the divorce papers after they are filed with the court (unless you are filing a joint divorce where both spouses sign the forms together).

    Missing Spouse - If you have no idea where your spouse is and have exhausted all reasonable means of finding him/her, you must get special permission from the court to get a divorce in this situation. Click here to learn more.

  6. Child Support & Divorce

If you have minor children child support should be paid in accordance with the Federal Child Support Guidelines. Click here to learn more about child support in Canada.

ezDivorce will not assist you if you are not paying child support in accordance with the Federal Guidelines. We suggest that you either start paying proper support or get your spouse to be the one to file the divorce. (If you are the one who is supposed to be paying support but are not, or are paying less than what the Federal Child Support Guidelines require, even if you have a written agreement for this, the court will in all likelihood refuse to grant your divorce until you pay in accordance with the Federal Guidelines.)

Fees

  • Simple Sole/Uncontested or Joint Ontario Divorce:
    $350 for a simple or joint divorce if either spouse lives in the City of Toronto
    $400 for the rest of Ontario (
    including the surrounding GTA regions of Halton, Peel, York and Durham)          

  • Mandatory court filing fees: $447. All but $10 of the court's fees can be waived if you meet certain low-income requirements. Click here for more info.
