Due to the difficulty in
with dealing with the clerks in St. Catharines and some
judges in Kitchener, if your divorce must be filed in one of
those locations (because both spouses reside in Kitchener or
both in St. Catharines, or one is in Kitchener and one is in

on your marriage certificate; 3. You have a copy of
your and/or your spouse's prior divorce certificate or
order/decree if you and/or your spouse were/was previously
divorce and the current marriage took place outside
on Ontario; and 4. Child support is being paid in
accordance with the Federal Child Support Guidelines - i.e.
not a cent less than the applicable Table amount if you have
minor children or you have adult children who reside with
your spouse and who are unable to become self-supporting due
to illness, disability, or full-time education (including
children who technically live with your spouse but actually
live on campus).
Court fee waivers for
divorce filed in Kitchener:
Despite its
responsibility under Sections 4.3 and 4.4 of
Administration of Justice Act, at last check, even if
you are eligible for the court fee waiver based on the
prescribed financial tests (above), the court in Kitchener
refuses to issue fee waivers if you pay a lawyer/agent to
assist you with your divorce. So, if you are eligible and
want the court fee waiver but have to file in Kitchener
because both you and your spouse reside in that area of
